We reserve the right to make amendments to any of our terms and conditions.
1. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
1.1. After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to availability and acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product(s) has/have been despatched together with any tracking number (the "Despatch Confirmation"). The contract between us (the "Contract") will only be formed when we send you the Despatch Confirmation.
1.2. We will not process your order until payment has been cleared.
1.3. The Contract will relate only to those products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the despatch of such products has been confirmed in a separate Despatch Confirmation.
1.4. If your order has already been despatched, please return any unsatisfactory products to us in accordance with our Returns Policy.
1.5. When making an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card or bank account that you used to make the payment and that there are sufficient funds to cover the cost of the products ordered.
2. PRICE AND PAYMENT
2.1. The price payable for any of our products shall be as shown on our website.
2.2. Payment shall be made by you by the means specified on our website and shall not be deemed to be made until we have received cleared funds in respect of the full amount stated in the order.
2.3. Prices are subject to change without notice but changes will not affect orders which we have already accepted.
2.4. Only one promotional or store credit code can be used per order.
2.5. Buyer must check the product code of the order before made payment. Before place the order please check the color and size you selected.
2.6. After payment, NO change or cancellation allowed.
2.7. Sold items are not refundable or exchangeable.
2.8. Payment will be 100% refundable for the item is out of stock.
2.9. Accessories are not inclusive of purchase unless stated.
3. AVAILABILITY AND DELIVERY
3.1. Your order will be despatched in accordance with our Shipping Policy.
3.2. Shipping rates are subject to change without notice but changes will not affect order which we have already accepted.
3.3. All the goods will be delivery to you within 2-3 weeks after the pre-order deadline.
4. OUR RETURNS POLICY
4.1. If you are not fairly satisfied by the product, then you can return in within 60 days of purchase of the order.
4.2. Refund is strictly in BabyLuv Apparel shopping voucher, we do NOT refund in cash basis.
4.3. Returned item must be in its original TAG, original PACKAGING, UNDAMAGED, UN-WASHED, UN-WORN.
4.4. It should be in the perfect condition as it was during delivery.
4.5. There may be a slight difference of 1-2 cm from any of our given measurements. In such cases, the variance is not considered as a defect.
4.6. Colours of products may slightly differ due to colour calibration on your individual computer. Colours may also appear slightly darker or lighter than in reality due to studio lighting and camera flash used. Such variances are not considered as a defect.
4.7. Should our products be purchased from a third party, we will not be liable for such purchase and will not accede to any request for return or exchange.
4.8. We accept a refund/return within 60 days of notification on the error based on valid reasons such as; incorrect colour or style of the outfit sent. Items are to be return with original tag, complete packing and accessories.
4.9. Washed,worn or self damaged items are not exchangeable.
5. OUR LIABILITY
5.1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”).
5.2. Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
5.3. Once the Despatch Confirmation is emailed to you, your products are under the responsibility of our third party postal service providers (Pos Laju or Malaysian Registered Mail) and we shall not be responsible for lost parcel in post if proof of postage is supplied. Any claim will have to be made with our third party postal service providers and we will use our reasonable endeavours to assist in claiming compensation (if any).
